These terms govern your use of The Funding Depot LLC’s website and portals. By using them you agree to these terms. If you do not agree, please do not use the site.
These terms are not your funding agreement. If we fund your business, that advance is governed by the agreement you sign — and if anything here conflicts with it, the signed agreement controls.
1. Who can use this site
You must be at least 18 years old and using the site for business purposes, on behalf of a business based in the United States. If you apply for funding, you confirm you are authorised to sign for that business and to provide the information and documents you submit — including anyone else’s details you give us as a reference.
Our products are commercial financing for business use. They are not consumer credit and are not offered for personal, family or household purposes.
2. Nothing on this site is an offer of funding
The amounts, ranges, terms and timelines described on this site are illustrative — they describe what is available generally, not what is available to you. Nothing on the site, in our chat, or in an email from us is a commitment to fund your business.
Being pre-qualified is not an approval. Any figure we show you before underwriting completes, including an estimate produced by our chat or displayed in your portal, is an estimate only and is subject to underwriting, verification and final approval. Funding is offered only in a written agreement signed by both sides. Where a state requires a disclosure of the cost of commercial financing, you will receive it with your offer.
3. Funding is for business purposes only
Everything we offer is commercial financing for a business. By applying you represent that you are seeking funds solely for business or commercial purposes, and not for personal, family or household purposes, and that you are authorised to apply on behalf of the business.
We do not offer consumer loans, and we do not fund applications where the money is intended for personal use.
4. The information you give us
You agree that everything you tell us is true, accurate and complete, and that you will tell us promptly if it changes. We may verify any of it. Submitting an application containing information you know to be false may be a criminal offence, and it entitles us to decline or withdraw funding.
When you sign an application you also authorise us and the funding partners we work with to obtain the reports and information described in that authorisation, including business and personal credit reports and bank information. The authorisation you sign sets out exactly what you are permitting.
5. Your portal account
If we give you access to a merchant or partner portal, you are responsible for keeping your password confidential and for everything done under your login. Do not share it. Tell us immediately if you think someone else has it.
We may suspend or close an account, or refuse access, if we believe it is being misused, if it poses a security risk, or if our relationship with you ends.
6. Electronic signatures, records and consent
Our application is signed electronically. By agreeing to sign electronically you consent to receive the application, the authorisation, disclosures, notices and agreements in electronic form, and you agree that your electronic signature has the same effect as a handwritten one.
When you sign, we record the name you typed, the consents you agreed to, the date and time, your IP address and your browser, together with a fingerprint of the document you signed. You can ask us for a copy of anything you signed. If you would rather sign on paper, contact us and we will arrange it.
7. Documents you upload
You keep ownership of the documents you upload. You give us permission to store them and use them to evaluate, document, fund and service your file, and to share them with funding partners for that purpose as your authorisation permits.
You confirm you have the right to give us each document, and that uploading it does not breach anyone else’s rights or an agreement you are under.
8. Contacting you
By giving us your phone number and email address you agree we may contact you about your enquiry, application, file and account by email and phone. We do not send text messages. Consent to marketing calls is not a condition of applying or of receiving funding, and you can opt out at any time. See our Privacy Policy for how we handle your information.
9. Our chat assistant
Our chat is automated and powered by an AI service. It gives general information about our products, it can be wrong, and it does not speak for us. Nothing it says is advice, an approval or an offer, and you should not rely on it in making a decision. Ask for a person whenever you want one. Please do not send your Social Security number, bank account numbers or other sensitive details through chat.
10. Acceptable use
You agree not to:
- Submit false, misleading or fraudulent information, or apply on behalf of a business without authority
- Use anyone else’s personal information without their permission
- Try to gain access to another user’s account, our systems, or any data you are not authorised to see
- Scrape, crawl, harvest or bulk-download the site, or use it to build a competing product or a dataset
- Interfere with the site’s operation or security, introduce malicious code, or place unreasonable load on it
- Use the site for anything unlawful, or in breach of these terms
11. Our content
The site and everything on it — text, design, graphics, logos, software and the platform behind it — belongs to The Funding Depot LLC or its licensors and is protected by intellectual property law. You may view and print pages for your own business use. You may not copy, republish, modify or use them commercially without our written permission. “The Funding Depot” and our logo are our trademarks and may not be used without permission.
12. Other sites and services
We link to sites and services we do not control. We are not responsible for their content, products or practices, and a link is not an endorsement.
13. The site is provided as it is
We work to keep the site accurate and available, but we provide it “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the site will be uninterrupted or error-free, that defects will be corrected, or that it is free of harmful components.
Nothing on this site is legal, tax, accounting or financial advice. Talk to your own advisers before taking on financing.
14. Limitation of liability
To the fullest extent the law allows, The Funding Depot LLC and its officers, employees and agents are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost business or lost data, arising out of your use of the site — even if we were told such damages were possible. Our total liability arising out of the site is limited to one hundred US dollars ($100).
Nothing in these terms limits liability that cannot be limited by law, and nothing here affects our obligations under a funding agreement you have signed with us.
15. Indemnity
You agree to indemnify The Funding Depot LLC against claims, losses and reasonable legal costs arising from your use of the site, from information or documents you submit, or from your breach of these terms — including a claim by someone whose personal information you gave us without their permission.
16. Governing law and where disputes are heard
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You and we agree that any dispute arising out of the site or these terms will be brought in the state or federal courts located in New York, and we each consent to those courts’ jurisdiction. A funding agreement may specify something different, and if so it controls for disputes under that agreement.
17. Changes
We may change these terms. The date at the top shows when they last changed, and using the site after that means you accept the change. We may also change, suspend or withdraw any part of the site at any time. This version is effective August 5, 2026.
18. Everything else
If any part of these terms is unenforceable, the rest still applies. If we do not enforce a term straight away, we have not given it up. You may not transfer your rights under these terms; we may transfer ours as part of a business transfer. These terms, together with our Privacy Policy and any authorisation or agreement you sign, are the whole agreement between us about the site.
