Privacy Policy

This policy explains what The Funding Depot LLC (“Funding Depot”, “we”, “us”) collects when you use our website, apply for funding, or sign in to a portal — and what we do with it.
We fund small businesses, so most of what we collect is about a business. But an application also asks for personal details about the people who own it, including Social Security numbers, dates of birth and driver’s licence numbers. This policy covers both.
1. Information you give us
When you ask about funding. Our forms and chat ask for your name, business name, email address, phone number, how long you have been in business, your monthly revenue range, how much funding you want, and your credit score range. If you type a message or ask for a callback, we keep what you wrote.
When you apply. The application asks for your business’s legal name and any DBA, federal tax ID, address, phone, email, website, entity type, industry, the date the business started, and whether it is seasonal. For each owner it asks for name, home address, phone, email, percentage of ownership, date of birth, Social Security number, driver’s licence number and credit score range. It also asks for your annual revenue, average bank balance, the amount you want, what you will use it for, whether you have open judgments, bankruptcies or tax liens, and details of any advance you are already paying back.
Business references. The application asks for two trade references and your landlord or mortgage company, including names and phone numbers. Those are other people’s details — by giving them to us you confirm you are allowed to, and we use them only to verify your business.
Documents you upload. Typically four months of business bank statements, a voided business check, and a government-issued photo ID for each owner. Partners submitting a deal may upload a signed application on a merchant’s behalf.
Your signature. When you sign an application electronically we record the name you typed, which consents you agreed to, the date and time, your IP address and your browser, plus a fingerprint of the exact document you signed. That record is what makes an electronic signature stand up, and we keep it with the signed document.
If you are a broker or ISO. We collect your business and contact details and the onboarding documents you send us, which may include a W-9, a signed partner agreement, a voided check and any licences.
2. Information we collect automatically
When you visit the site we record technical information: your IP address, browser and device type, the page that referred you, the marketing parameters in the link you arrived on, and the pages you view.
When you sign in to a portal we set one cookie that keeps you signed in. It is required for the portal to work and cannot be turned off while you are signed in. We may also use analytics services to understand how the site is used in aggregate.
3. Information we get from others
- Credit reporting agencies. With your authorisation we obtain business and personal credit information. A soft inquiry to see your options does not affect your credit score. A hard inquiry may be made later in underwriting, and we will have your authorisation before it is.
- Your bank and payment processors, where you have authorised us to obtain statements or processing history.
- Brokers and ISOs. If a partner submitted your file, we receive the information and documents they collected from you.
- Verification, public and commercial databases, used to confirm identity, business registration and to prevent fraud.
4. How we use it
- To evaluate your business and decide whether we can fund it, and on what terms
- To verify identity and business ownership, and to detect and prevent fraud
- To prepare, present and document offers and agreements
- To fund and service an advance, including collecting the agreed payments
- To operate the merchant and partner portals, including your login and notifications
- To communicate with you about your application, your file and your account
- To improve the site, our products and our underwriting
- To comply with law, respond to lawful requests, and enforce our agreements
5. Automated review of your bank statements
When your statements are on file, an underwriter can run them through an automated service that reads them and extracts figures we use in underwriting — monthly deposits, deposit counts, average daily balance, days with a negative balance, returned items, and any recurring payments that look like advances you already have.
Your statements are sent to that service directly by our server for the purpose of reading them. They are never made publicly accessible to do it.
The figures it returns are not a decision. They are marked unconfirmed until a person at Funding Depot reviews and confirms them, and a person decides whether to make you an offer and on what terms. You can ask us what the automated review returned on your file.
6. The chat assistant
Our website chat is powered by an AI service. What you type is sent to that provider so it can generate a reply. We do not keep chat conversations on our servers, and we do not use them to make funding decisions — if you ask for a callback or hand off to a person, we keep the contact details you give us as an enquiry.
Please do not put your Social Security number, bank account numbers or other sensitive details into the chat. Use the application in your portal, which is built to handle them.
7. When we share information, and with whom
Funding partners. The authorisation you agree to when you sign an application permits us to send your application and the information we gather with it to lenders, funders and other finance providers we work with, so your file can be considered for funding. We share what those partners need for that purpose.
Credit reporting agencies, to obtain reports as authorised, and to report payment performance where applicable.
Your broker or ISO, where a partner submitted or is servicing your file — limited to the status and information they need to do that.
Service providers who work for us. They may only use the information to provide their service to us, under contract. They include our hosting provider, our database and file storage provider, our email delivery provider, the AI provider that reads statements and powers chat, and our payment processor.
Professional advisers, such as auditors and lawyers, where they need it.
Legal and regulatory. When the law requires it, in response to lawful requests, or where we need to establish, exercise or defend legal claims, prevent fraud, or protect someone’s safety.
A business transfer. If the business is sold, merged or reorganised, information may transfer as part of it, subject to this policy.
8. We do not sell your information
We do not sell, rent or trade your personal information to marketers, data brokers or anyone else for their own use, and we do not share it for cross-context behavioural advertising. Sharing your file with funding partners so it can be considered for funding is not a sale — it is what you asked us to do.
9. Calls and email
We contact you about your application, your file and your account by email and phone. We do not send text messages. If we introduce them later, we will ask for your consent first and tell you how to stop them.
You are not required to agree to marketing calls to apply or to receive funding. You can opt out at any time — use the unsubscribe link in a marketing email, tell us on a call, or contact us. We will still send you messages we need to send about an active application or account.
10. How we protect it
- Traffic to and from the site is encrypted in transit
- Documents live in private storage, never publicly accessible, and are opened only through short-lived links issued to signed-in staff
- Access is limited to the staff whose role requires it, and every access-controlled action is logged
- Passwords are stored only as a one-way hash — nobody at Funding Depot can read your password
- Your full Social Security number appears only in the signed application document held in private storage. Our records keep the last four digits
No system is perfectly secure, and we cannot guarantee absolute security. If a breach affects your information, we will notify you and the regulators as the law requires.
11. How long we keep it
We keep information for as long as we need it for the purposes in this policy, and then for as long as the law requires us to keep records. In practice that means an enquiry that goes nowhere is kept for a limited period; an application, whether funded, declined or withdrawn, is kept for the period required for financial recordkeeping, regulatory and fraud-prevention purposes; and a funded file is kept for the life of the advance and the retention period that follows it. After that we delete it or strip it of anything that identifies you.
12. Your choices and rights
You can ask us to: give you a copy of the personal information we hold about you; correct it if it is wrong; delete it; or stop sending you marketing. Contact us using the details at the end of this policy and we will respond as the law requires.
We will need to verify who you are before acting on a request, and we may keep information where we are legally required to, or where we need it for an active application, an existing advance, or to prevent fraud. If we cannot do what you asked, we will tell you why. You may use an authorised agent to make a request. We will not treat you differently for exercising these rights.
13. California residents
Under the California Consumer Privacy Act, as amended, this is what we do with personal information about California residents.
Categories we collect: identifiers (name, postal address, email, phone, IP address, Social Security number, driver’s licence number); commercial information (the funding you asked for and were offered, and your payment history with us); financial information (bank account and statement information); internet activity (how you use our site); geolocation inferred from IP address; professional information (your role in the business); and audio or electronic records such as the signature record described above.
Sensitive personal information: Social Security number, driver’s licence number, and account log-in and financial account information. We use it only to provide the funding you asked for, to verify identity, to prevent fraud and to comply with law — the purposes California permits without a separate right to limit — and not to infer characteristics about you.

Purposes: as set out in section 4.
Disclosures: we disclose the categories above for the business purposes in section 7. We have not sold personal information, and we have not shared it for cross-context behavioural advertising, in the last twelve months.
Your rights: to know what we collect and how we use and disclose it; to a copy of it; to correct it; to delete it; and not to be discriminated against for asking. Contact us to exercise them.
14. Nevada, and other states with privacy laws
Nevada residents may ask us not to sell their covered information. We do not sell it, but you may still send the request.
If your state gives you rights to access, correct, delete or obtain a copy of your personal information, or to appeal a decision we make about such a request, you have those rights and we honour them. Contact us and tell us which state you live in.
15. Business information and personal information
Much of what we hold is information about a business, which privacy laws generally treat differently from information about a person. Information about you as an owner, guarantor or authorised representative — your name, home address, date of birth, Social Security number, driver’s licence number, personal credit — is personal information, and this policy applies to it.
16. Children
Our site and services are for businesses and for people aged 18 or over. We do not knowingly collect information from children. If we learn that we have, we will delete it.
17. Other sites we link to
Our site links to sites we do not control, including our partners’. Their privacy practices are their own — please read their policies.
18. Do Not Track
Browsers can send a “Do Not Track” signal, but there is no agreed standard for responding to it, so our site does not respond to it. We do not allow third parties to track you across other sites for advertising.
19. Changes to this policy
We may update this policy. When we do we will change the date at the top, and if the change is significant we will say so on the site or tell you directly. This version is effective August 5, 2026.
